Terms and Conditions - NIVEA 'My Best 48 Hours' Video Competition 

1. Introduction

1.1. This Promotional Competition (“Competition”) is organised by Beiersdorf Consumer Products (Pty) Ltd and/or its marketing agencies (collectively ‘’Promoters’’).

1.2. By entering this Competition, you confirm that you have read and understood these rules, and that you agree to be bound hereby (“the Rules”).

 

2. Duration

2.1. This Competition runs from 16 August 2018 until 09 September 2018, and from 12 September 2018 until 18 September 2018. (“the Duration”).Any votes received outside the Duration will not be valid.

2.2. The Promoters reserve the right to extend and/or limit the Competition Duration in their sole discretion.

 

3. Participants - who may enter the competition

3.1. The promotional competition is only open to participants that participated in the 2018 NIVEA mall activations in South Africa, and had a ‘My Best 48 Hours’ video uploaded on to www.niveamy48hours.co.za, who are permanent residents and citizens of South Africa over the age of 18 years in possession of a valid South African identity document, except any employee, director, member, agent or consultant of the Promoters, and/or their immediate family members. The Promoters reserve the right to request proof of identity and/or engagement to determine whether the participant is eligible for entry.

3.2. By entering the Competition, all participants and winner agree to be bound by these Rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend and/or modify and/or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary.

 

4. Entry

4.1. The participants ‘My Best 48 Hours’ video will be posted on www.niveamy48hours.co.za by the Promoters.

4.2. Participants must share their video on Facebook, Instagram or Twitter, encouraging their friends and/or followers to click the link and vote for their video on www.niveamy48hours.co.za

4.3. Entries which are submitted via an incorrect entry mechanism, contain errors, or are from Disqualified Persons, will be declared invalid.

 

5. Prize and Winner Selection

5.1. The prize, for the ‘My Best 48 hours’ video which receives the most public votes, is a year’s supply of NIVEA Rich Nourishing Lotion which is 12 x bottles of NIVEA Rich Nourishing 400ml and 12 x NIVEA Rich Nourishing Cream Tubs. The winning video will be used as the cover video on NIVEA South Africa’s Facebook page for 48 hours.

5.2. The first round of public voting will take place between 16 August 2018 and 09 September 2018.The top 3 finalists will selected and announced on 10 September 2018, based on the most number of public votes received.The second round of public voting, on the top 3 finalists, will take place between the 10 September 2018 and 18 September 2018.

5.3. Voting will be verified and the winning entry selected, from the top 3 finalists, on 19 September 2018, based on the most number of public votes received.

5.4. The winner will be notified telephonically on the 19 September 2018.If the winner cannot be contacted, via the platform, after 6 attempts within a period of 72 hours for any reason whatsoever, the prize will be forfeited and another winner will be selected in accordance with the Competition Rules.

5.5. The Promoters may advertise the Competition and it winners on social media and/or other digital platforms.

 

6. General

6.1. The Promoters reserve the right in their sole discretion to disqualify any entrant if they have reasonable grounds to believe that an entrant has breached any of the Rules, or any applicable law (including copyright law). Each entrant acknowledges and agrees that any failure to comply with the Rules could lead to the Promoters disqualifying that person, without the Promoters giving any reason for such disqualification or granting any opportunity for challenge.

6.2. The winner will be required to identify themselves with a valid South African identity document. Refusal or inability to comply will disqualify the winner and a new winner may be drawn in his/her place at the sole discretion of the Promoter.

6.3. The winner will be required to provide an address in South Africa where the prize can be delivered, and sign a receipt for any prize received.Failure to comply or to claim the prize will disqualify the winner and a new winner may be drawn in their place at the sole discretion of the Promoter.

6.4 The prize is neither transferable nor redeemable for cash and the Promoters are not liable for any defect therein. The Promoters reserve the right to substitute the prize with any other item of comparable commercial value.

6.5. Should any dispute arise in relation to the interpretation of these Competition Rules, the Promoters’ decision shall be final, and no correspondence will be entered into.

6.6. All participants and the winner, as the case may be, fully indemnify the Promoters and waive all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters) and/or use of the prize(s).

6.7. The Promoters may require the winner to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008 (“CPA”). Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the prize and withdraw from the Competition; in this event, the prize shall revert back to the Promoters.

6.8. The Promoters may require the winner to be identified, photographed and published in social media, electronic media, printed media, or to appear on radio and television, when accepting his/her prize and/or after having received his/her prize. The winner will be given the opportunity to decline the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.

6.9. In terms of the CPA, all participants (and winner) specifically consent to the Promoter contacting them to provide them with useful information relating to products, upcoming offers and other related information.  After having opted in to this communication, at all times, the participants and winner may opt-out of the communication by sending an e-mail to ConsumerSA.External@beiersdorf.com.

6.10. Participants will be required to provide personal information when entering the Competition. All participants consent to the Promoter collecting and using the personal data listed herein in order to enable participation in this Competition and for related activities.The personal data will be used to enter the Competition and for the Promoters marketing purposes and by participating in the Competition, participants consent to the transfer, storage and processing of the data in South Africa, which consent may be withdrawn at any time by written notification to the Promoter.Personal data is kept to fulfil the purposes for which it was collected or as required by applicable laws and regulation.Personal data will not be used for a different purpose without first obtaining permission from the participants.The Promoter does not allow third parties to use the personal information.

6.13. Any provision of these Rules or the Competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions.

6.14. This Competition shall comply with, and will be subject to, any peremptory provisions of the CPA, which are deemed to be incorporated herein. In the event of any conflict between the Rules and the CPA provisions, the latter shall prevail. Copies of the CPA and the regulations promulgated thereunder are available on the Department of Trade and Industry Website: www.dti.gov.za.

4.2. Standard internet and data rates apply for voting.

4.3. Entries which are submitted via an incorrect entry mechanism, contain errors, or are from Disqualified Persons, will be declared invalid.

 

5. Prize and Winner Selection

5.1. 48 public voter winners will be chosen. The prize, for the each of the 48 ‘My Best 48 hours’ public voters, is a year’s supply of NIVEA Rich Nourishing Lotion which is 12 x 400ml bottles of NIVEA Rich Nourishing lotion

5.2. The winners will be drawn at random on 19 September 2018, from all valid public votes received.

5.3. The winners will be notified telephonically on the 19 September 2018.If the winners cannot be contacted, after 6 attempts within a period of 72 hours for any reason whatsoever, the prize will be forfeited and another winner will be selected in accordance with the Competition Rules.

5.4. The Promoters may advertise the Competition and its winner on social media and/or other digital platforms.
